Legal Notice published introducing immediate payment of fines for persons not resident in Malta

A Legal Notice has been published today which will allow for the issuance of on-the-spot fines to be paid immediately on the spot by persons who are not residents of Malta. These fines cover minor offences and contraventions.

This measure addresses a long-standing challenge where, in a number of cases, fines issued to non-residents remain unpaid. With the new legal framework, payment of the fine can be made immediately at the time of the contravention, thereby strengthening law enforcement. At the same time, if a person does not pay the fine, their passport or travel document will be withheld.

It is also worth noting that this law does not remove anything from the right of the person paying the fine to submit a petition to contest the same fine.

Minister for Home Affairs and Security Glenn Bedingfield said that this is another measure that continues to strengthen the protection of public order and the effective enforcement of laws. “Malta welcomes millions of visitors every year and we must continue to ensure that everyone, both residents and those visiting our country, respect the rules. This measure is not against tourists, but in favour of justice and equality before the law. Those who choose not to respect the rules must bear responsibility for their actions, regardless of where they come from.”

The Minister for Justice, Research and Innovation, Clifton Grima, said that the Legal Notice is another step towards a more effective and fair justice system. “This measure closes a loophole that was hindering law enforcement and at the same time safeguards the right of every person to challenge the fine in the competent forums. We are continuing to build a modern legal framework that strengthens accountability and increases trust in the justice system .”

The Legal Notice came into force today with the aim of continuing to strengthen law enforcement, promoting greater accountability and contributing to Malta remaining a safe, organised and welcoming country for all.
