Government clarifies Pardon for benefit fraud

With reference to the Statement PR240672, regarding those who applied irregularly and took assistance for severe disability that they were not entitled to and that as recommended by the Cabinet of Ministers to the President of Malta, it is possible to get a pardon, the  procedure applies to:
(1) persons who from 1 January 2022 onwards have been found guilty by a Criminal Court of crimes resulting from the fact that those persons received as beneficiaries in any way but improperly, a social benefit that they were not entitled to;
(2) persons who have criminal proceedings pending before any Criminal Court regarding the same crimes committed in circumstances similar to those referred to in paragraph (1);
and (3) persons who obtained a social benefit that was not due to them in circumstances similar to those being referred to and that it is possible to take criminal proceedings against them because of that fact; and this with the exclusion of the persons who were the creators, promoters or instigators of the crimes covered by this pardon.
Accordingly, and in accordance with the terms of the Proclamation issued by the President of Malta as communicated in the most clear way in a statement by the Government of Malta mentioned above, each person indicated in paragraphs (1), (2) or (3) who wishes to be considered to benefit from this pardon, must first of all make a request through their legal representative to the Director General of Social Security by confirming among others that they wish to return the money that they have taken  and provide information on how they will repay what is owed.
After all the necessary verifications are made, as soon as the person either pays back all the money, or enters into a written agreement to start paying back the money, the request for a pardon is sent to the Police Commissioner and eventually to the Ministry for Justice so that the latter can confirm the issuance of the pardon to the applicant.
