Three University of Malta students and a lecturer who ended up facing criminal charges after they in good faith disclosed security vulnerabilities in an app have been granted a Presidential pardon under Article 93 of the Maltese Constitution.
This follows a political commitment made by Prime Minister Robert Abela and the recommendation of the Cabinet of Ministers that these three young people and the lecturer not face further charges in a case of ethical hacking.
The Prime Minister had maintained that this matter should not be addressed solely from a legal perspective but from what is just and right, where the State should always take responsibility when an update of the country’s laws is necessary to reflect technological realities.
Thus, under political commitment, the Government addressed the injustice done to these young people and a lecturer under the prerogative of the Cabinet and the criminal proceedings against the individuals in question were concluded in their entirety.
